- do you have right to get alimony on the basis of a legal decision made by court?
- Does a debtor evade fulfilling the court decision?
- Aren't you provided with the agreed upon amount of alimony at the scheduled time and are your rights violated?
We will help you execute your legal rights and will ensure compulsory payment of an alimony by a debtor!
What you have to do for that is to present the following documentation:
Alimony is one of the decisions bound to the immediate enforcement. As soon as the enforcement proceeding begins, a debtor gets registered in Debtor's Register and is delivered a statement about an immediate fulfilment of the decision. After the delivery of the statement, or if it can't be managed to be delivered timely, an enforcement officer starts the quest of a debtor's property, attaches it and draws up a census act. Within 2 months from attachment, an initial auction is announced.
In cases related to alimony payment when a debtor location is unknown or when he/she evades fulfilling the duties, an enforcement officer applies to court to search for a debtor via police. A lawyer announces a relevant verdict on the case.
In alimony-related cases, a creditor is free from pre-paying enforcement costs. A debtor is obliged to pay the 7% of the application value that is the enforcement costs form the very start of the enforcement procedures.
Sums received from a debtor are transferred to the NBE deposit account. The funds will be used to cover the enforcement due and alimony will be transferred to a debtor on the bank account presented by the latter.
To evade paying alimony by a debtor results in criminal charge.
